KTM and Husaberg Motorcycle Recall Due to Risk of Handlebars Falling Off

Our motorcycle accident lawyers are investigating a recall issued by KTM North America Inc., of Murrieta, California, of about 6,117 off-road motorcycles. The motorcycle handlebar clamp can develop cracks during normal use causing the handlebars to move from their set position. This can result in the handlebars falling off or out of position and the rider losing control of the vehicle.

KTM received a report of one incident in which the consumer was hospitalized from injuries received in a crash after the handlebar clamps cracked and failed to secure the handlebars. Attorney Fred Pritzker won $3,500,000 for a man injured in a similar accident with another off-road motorcycle that had been recalled by another manufacturer/distributor. In that case, the man was racing the motorcycle at the time of the accident. His leg was badly crushed, and it was later amputated.

This KTM Motorcycle recall involves all 2011 KTM and Husaberg off-road/competition motorcycles.

KTM models included in this recall:

Engine Size Model
150 XC, SX
200 XC-W
250 XC, XC-W, XCF-W Six Days, SX, SX-F
300 XC, XC-W

450 XC-W Six Days, SX-F
530 XC-W Six Days

Husaberg models included in this recall:

Engine Size Model
390 FE
450 FE, FX

The affected Husaberg bikes are blue, yellow and white in color with the model name and Husaberg logo located on the right and left shrouds. The recalled KTM and Husaberg motorcycles were sold at authorized KTM and Husaberg dealers nationwide from April 2010 through May 2011 for between $6,200 and $9,500.

Kawasaki Recalls 2011 Ninja ZX-10R – ZX-10R ABS

Kawasaki Motors Corporation recalled certain model year 2011 Ninja ZX-10R/ZX-10R ABS (ZX1000JBF/JBFL/KBF/KBFL) motorcycles. A portion of the wiring harness may become pinched between the rear subframe and the rear fender or between the rear subframe and the bolt holding the seat cover. This can damage the harness and wiring and result in a short between wires and the frame or within the wires, which could result in the engine stopping suddenly.

The recall affects 2,560 motorcycles. If a recalled motorcycle stalls while being ridden, it could increase the risk of a crash. Dealers will repair the motorcycle as necessary and reroute the main harness, at no charge. Visit safercar.gov for more information about recalled motor vehicles.

ZX1000JBFL 2011
ZX1000JBL 2011
ZX1000KBFL 2011
ZX1000KBL 2011

Because a motorcycle accident may occur due to a defective product, Attorney Fred Pritzker represents bikers in product liability (defective product) claims against manufacturers of defective motorcycles and defective motorcycle parts. He recently won $6,000,000 on behalf of a 26 year-old female passenger whose right leg was traumatically amputated when the motorcycle on which she was a passenger was struck by a drunk driver.

Honda Motorcycle Recall on ST1300, ST1300A and ST1300PA

Honda recalled certain model year 2008 – 2010 motorcycles for a possible brake fluid leak. When the rear suspension of the motorcycle is repeatedly completely compressed, the rear brake reservoir hose may become damaged and leak brake fluid. Should this happen, the rider will experience a loss of rear brake performance which could increase the risk of a crash.

The recall is set to begin on or before July 26, 2011 and affects more than 2, 200 units. To remedy the problem, dealers will replace the rear brake reservoir hose free of charge. For additional information about recall vehicles, visit safercar.gov.

Recall on 2009 – 2011 Indian Motorcycles

Polaris is recalling certain model year 2009-2011 Indian motorcycles. The body control module (BCM) may cause the headlight to turn off in some circumstances. The recall affects 699 motorcycles.

When the headlight switch is moved from high beam to low beam (or low beam to high beam) in a slow manner, both beams may be on momentarily and the BCM interprets this as an overload condition. The BCM turns off the headlight until the next time that the key is turned on. The unexpected loss of headlight function could impair a motorcyclist’s visibility and increase the risk of a crash.

This recall was issued on June 24, 2011 along with another recall due to problems with the kickstand. Both recalls are expected to begin in August 2011. Dealers will replace the BCM and kickstand at no charge. The safercar.gov website provides additional information on recalls.

Pritzker Olsen attorneys have seen the damage that can be done in a motorcycle accident. We recently obtained a $3,750,000 settlement for a client whose leg had to be amputated following a motorcycle accident. A defect in the vehicle caused the man to lose control and crash.

Our firm practices extensively in the area of product liability. In the above mentioned case, Attorney Fred Pritzker worked with engineering specialists to replicate the failure mode that gave rise to the crash. Mr. Pritzker then presented the evidence proving that the product was defective and that the defect caused the crash.

Yamaha FJR1300 2006 – 2009 Recalled

Yamaha recalled certain model year 2006 – 2009 FJR1300 motorcycles manufactured from February 2006 through March 2009. The ground joint connector of the wire harness could overheat and become deformed and cause an intermittent ground wire connection. If the electrical system is not properly grounded, the ignition system and other electrical components may malfunction and cause the engine to stall. An engine stall could lead to a crash resulting in injury or death.

The recall affects 9,850 motorcycles and is set to begin in July 2011. Yamaha dealers will install an additional wire sub-lead or a new main wire harness (if the ground joint connector has already been damaged from overheating) free of charge. Additional recall information is available at safercar.gov.

Kawasaki Recalls 2009 – 2010 KLX250

Kawasaki Motors recalled certain model year 2009 – 2010 KLX250 motorcycles. The fuel tank could leak from cracks on the side mount tabs, at the spot welds, due to stress caused by excessive clearance between the fuel tank and a frame-mounted rubber damper. A fuel tank leak in the presence of spark or flame could cause a fire or explosion possibly resulting in injury or death.

The recall, which affects 9,460 motorcycles, was expected to begin in June 2011. Dealers will inspect and correct the fuel tank as necessary, at no charge. Visit safercar.gov for more information.

Product Liability Lawsuit

A product liability lawsuit involves injury or death caused by a defective product. A product may be defective due to a manufacturing flaw or a design defect. The manufacturer has a duty to “design out” dangers inherent in the product.

A product liability lawsuit is complex, requiring experienced product liability lawyers with sufficient resources to properly evaluate and prove product defects. This is crucial since the defendants in these cases are often large companies with seemingly unlimited resources to defend against such claims.

For a free consultation with one of our motorcycle accident lawyers regarding a Kawasaki injury lawsuit, please call 1-888-377-8900 (toll free) or submit our online form. Attorney Fred Pritzker has recovered multi-million-dollar settlements and verdicts in product liability cases. He is a Minnesota Super Lawyer and is listed in The Best Lawyers in America.

Honda 2010-2011 VT750 Recall

On June 1, 2011, Honda issued a recall on certain model year 2010 – 2011 VT750 motorcycles produced from June 25, 2009 through March 28, 2011. The bank angle sensor may be incorrectly manufactured
creating the possibility of an inaccurate reading. An erroneous reading could cause the engine to stall and increase the risk of a crash.

The Honda recall affects more than 3,000 units. It is set to begin on June 20, 2011, at which time Honda will replace the affected bank angle sensors. For more information on Honda motorcycle recalls, see safercar.
